Is itpossiblefora UK citizen to file for litigation against a U.S company for breach of an internet contract?
Nov 04, 2006 by nigelbeardsley | Posted in Law & Ethics
I recently paid online for a dedicated server to a U.S based party. I was told i would get my account info and use of the server within 24 hrs. It is now 3 days later and no account info and no server. Notwithstanding my numerous e-mails i get no reply. After the 24 hrs had passed i managed to swap a combine of e-mails witha live customer support who assured me the server was being setup and would be accessible to me soon. But since tat still nothing. How to i go about making a claim for compensation against this company that is based in the U.S. I am in the UK. Thanks.
Anything is accomplishable under international law, particularly for clear cut territories like UK/US. To avoid expensive lawyers fees, you can get authorized advise in the UK (or even Legal Aid) to obtain an injunction... that's assuming the other party is legit/operational.

How does one go about starting a trading-standards case?
Aug 08, 2007 by Spanglish McWhirter | Posted in Corporations
How does one go about starting a trading-standards occurrence (or "claim" or "file" or what-have-you!)?
The UK rental server performers 123-Reg advertise their dedicated servers as having "instant activation". But the subject is, it's almost never instant for anyone! And can actually take up to three days!!
Nowhere in the small print does it say "sometimes 'on the spot' activation isn't actually instant" or whatever and so I wondered how to sort this out once and for all...
Basically a box like this would fall under the Control of Misleading Advertising Regulations. Basically speaking, these state of affairs that advertising must be accurate and must not mislead. Companies must adhear to these regulations.
You can complain to the Advertising Standards Police, but they will only usually look into matters if there is evidence of a large amount of consumer detriment (i.e. many complaints showing substantiation of big companies doing wrong), and then will only aim to correct the advertising or punish the company... they have no powers to better you personally.
Trading Standards Services (TSS) have the same powers as the ASA, but on a local level, ie they can calling towards correcting the advertising of (or punishing) smaller local companies. However, they can also help consumers subsist redress.
Your best bet would be to find contact details of your local TSS via the Trading Standards website: http://www.tradingstandards.gov.uk/ and just give your local branch a call. They will advise and help you on what to do to obtain redress/refund or whatever you're after.
However, most conceivable the number given on the website I just gave will put you through to Consumer Direct (CD) rather than of your local TSS. This is a new government help line which should be able to advise you on your rights and acquaint someone with something you what you need to do to obtain redress -and the goverment would rather you call them first, so have made some Trading Standards phone numbers moor to that instead. CD can be pretty helpful, so try it out first, but if you find CD unsatisfactory, contact your local TSS direct by determination the 'real' phone number from 118500 or from the website of the TSS the link above provides you.
